Cancellation Policy
Photography Services Agreement: Terms & Conditions 1. The Contract & Jurisdiction These Terms and Conditions are governed by the Laws of Scotland and are subject to the exclusive jurisdiction of the Scottish courts. The "Photographer" refers to Lomond Photography, and the "Client" refers to JC Cheer or the individual parent/guardian (as specified in the booking). 2. Booking & Cancellation Booking Fee: Full session payment is required to secure the date. Cancellation: If the Client cancels within 5 days of the shoot, the full fee remains payable due to the difficulty of rebooking a dedicated time slot for a large group. Rescheduling: In the event of adverse weather (for outdoor shoots) or squad illness, one reschedule will be offered at no extra cost, subject to availability. 3. Permissions & Safeguarding As this involves minors, the Photographer adheres to the Protection of Vulnerable Groups (PVG) Scotland guidelines. Supervision: A designated official from the Cheer Squad or a parent/guardian must be present at all times. The Photographer will not be left alone with minors. Consent: The Client (the Squad) warrants that they have obtained written consent from the legal guardians of all participating children for them to be photographed. 4. Model Release & Image Use By signing this agreement, the Client grants the Photographer the following rights, unless otherwise opted-out in writing: The License: The right to use the images for promotional purposes, including portfolios, social media, and studio marketing. Privacy: No names or sensitive personal details of the children will be published alongside the images without specific, additional written parental consent. 5. Data Protection (GDPR & UK DPA 2018) The Photographer is a "Data Controller" under the UK GDPR. Processing: Personal data (names, contact info, and images) is processed solely for the purpose of fulfilling the contract and delivering the images. Storage: Images will be stored securely for [Number] years. Rights: Parents/Guardians have the right to request access to, or the deletion of, their child's personal data, subject to the Photographer’s need to retain records for tax/legal purposes. 6. Copyright & Digital Ownership Copyright: The Photographer retains the entire copyright of all images taken at all times throughout the world.
